STUDS PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents (this “Notice”) supplements the information contained in the STUDS PRIVACY POLICY (the “Policy”) and applies solely to visitors, users, and others who reside in the State of California (“Users” or “you”) who visit the Site or use the Services.

We adopt this notice to comply with the California Consumer Privacy Act of 2018 (the “CCPA”), the California Privacy Rights Act of 2020, effective January 1, 2023 (the “CPRA”) and other California privacy laws (collectively referred to in this Notice as “California Laws”). Any terms defined in the CCPA and CPRA have the same meaning when used in this notice. Any terms not defined in this Notice have the meaning set forth in the Policy.

1. INFORMATION WE COLLECT

Our Site collects Personal Information. For purposes of this Notice, “Personal Information” includes information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device. Our Site also collects some “Sensitive Personal Information.” For purposes of this Notice, “Sensitive Personal Information” has that meaning given to it under the California Laws.

Personal Information does not include:

• Publicly available information from government records;
• Deidentified or aggregated consumer information; and
• Information excluded from the scope of the California Laws, like information covered under other privacy laws (e.g., the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Fair Credit Reporting Act (FCRA)).

In particular, please see the following summary of Personal Information that we have collected in the past twelve (12) months preceding the Effective Date of this Privacy Policy (the “12-month period”), as well as the sources of that Personal Information, the purposes of collection, and third parties with whom we have shared such Personal Information during the 12-month period. This information is provided based on the categories of Personal Information and business and commercial purposes defined within the California Laws.

• Studs does not use or disclose Sensitive Personal Information other than to provide you the Services, to comply with legal requirements, and otherwise as permitted by the California Laws.
• In the past (12) months, Studs may have used:
• Your Driver’s license, state identification card, or passport number,
• Your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; and/or
• Your precise geolocation while you are in a Studs Studio.

solely to provide you with the Services and as permitted by California law. 

2. SALE AND SHARING OF PERSONAL INFORMATION

We sell or share (as defined by the California laws) Personal Information with third parties for the purpose of serving you interest-based ads about Studs’ products and services on other websites and online services. 

In the past twelve (12) months, we have sold or shared the following categories of Personal Information for the purpose of showing you ads about Studs:

To our knowledge, we do not “sell” or “share” (as defined in the California Laws) the Personal Information of California Consumers under 16 years of age. 

3. YOUR RIGHTS AND CHOICES

Under the California Laws, California residents have certain rights regarding their Personal Information.  Subject to certain exceptions, California residents have or may exercise the following rights:

Right to know about personal information collected, disclosed, shared, or sold. A California resident has the right to be informed about the information practices of a business (including the purposes for which categories of Personal Information are collected or sold, the categories of sources from which a business collects Personal Information, and categories of third parties to whom a business discloses or sells Personal Information) , and the specific pieces of Personal Information (including Sensitive Personal Information) that a business holds about that resident. 

Right to request deletion of personal information. A California resident may request that a business delete their Personal Information. 

Right to request a correction to inaccurate Personal Information. A California resident may request that a business correct any inaccurate Personal Information (including Sensitive Personal Information) that we have about you, taking into account the nature of the Personal Information and the purposes of the processing of the Personal Information. 

Right to Opt-Out of the sale of personal information. A California resident has the right to opt-out of the sale of their Personal Information by a business.

Right to Opt-Out of sharing. A California resident has the right to opt out of the sharing of their personal information to a third party for cross-context behavioral advertising. 

Right to Non-Discrimination for Exercise of Consumer Privacy Rights. A California resident has the right not to receive discriminatory treatment by a business for the exercise of privacy rights provided by the California Laws.

Please note, however, that the rights set forth in this section are subject to certain exceptions, including Studs’ rights to retain certain information as set forth in section 6, below, titled “Retention.”

Please understand that we are only obligated to respond to verifiable consumer requests.  If we receive a request for information about you, we need to know that it is actually coming from you, or an agent who is legally authorized to act on your behalf.

In order to verify a request, we may ask for certain Personal Information, including at least the name and email address of the person who is the subject of the request, and we may implement authentication procedures that are appropriate to the nature of the request. We may also use any information that we have already collected in order to verify a request. If we collect any new Personal Information (that we do not already hold for another purpose) in order to verify a request, we will only use that information to verify the request.

Please remember that we are only obligated to respond to a request for access twice within a 12-month period.

Opt-Out Preference Signals.  You may also opt out of the sale or sharing (for cross-context behavioral advertising purposes) of your Personal Information by turning on the Global Privacy Control (GPC) in participating browser systems. 5. RETENTION

We will keep your Personal Information for as long as it remains necessary for the identified purpose or as required by law, which may extend beyond the termination of our relationship with you. We may retain certain data as necessary to prevent fraud or future abuse, or for legitimate business purposes, such as analysis of aggregated, non-personally-identifiable data, Account recovery, or if required by law. Unless otherwise set forth in the applicable Terms of Service or a separate agreement with you governing the applicable Services, if you cease using such Service, we may retain or destroy, at our discretion, all Personal Information and non-personally identifiable information we collect through your use of such Service. All retained Personal Information will remain subject to the terms of the Policy.

6. AMENDMENTS TO THIS NOTICE

We reserve the right to amend this Notice at our discretion and at any time.  When we amend this Notice, we will post the updated notice on the Site and update the notice’s effective date. Your continued use of our Site following the posting of changes constitutes your acceptance of any such amendments.
